Tim McCaffrey began his career representing a variety of large employers in state and federal court while working as a Counsel for O’Melveny & Myers, LLP recognized as one of the nation’s most elite law firms. Opening a private practice in 2005, he now specializes in representing individuals and small to mid-size companies with respect to all aspects of employment law.
Mr. McCaffrey litigates all types of employment related claims, including claims for wrongful discharge, discrimination, harassment, retaliation, failure to accommodate, intentional infliction of emotional distress, fraud, breach of contract, claims for unpaid wages, and fraudulent or unfair business practices and competition. In addition, he has represented clients in ERISA and employment discrimination class action matters and has handled administrative matters before state and federal agencies, including the Department of Fair Employment and Housing, the Division of Labor Standards Enforcement, the Equal Employment Opportunity Commission, the Employment Development Department, and the Occupational Safety and Health Commission. Mr. McCaffrey also has experience representing clients in traditional labor matters under the National Labor Relations Act and the Railway Labor Act.
Mr. McCaffrey counsels clients as to their rights and obligations under state and federal laws regarding family leave, wage and hour, and other employment-related issues. He also negotiates and drafts severance arrangements and employment and independent contractor agreements. He has conducted onsite training for clients regarding sexual harassment and drafted employment policies for a variety of clients, including entertainment companies, Internet companies, and school districts. For his achievements, Mr. McCaffrey has been ranked No. 32 in eBossWatch's list of the nation's Top Employment Lawyers and recognized by Super Lawyers. He also serves as an adjunct professor of Employment Law at Southwestern Law School.
