SEXUAL HARASSMENT
Sexual harassment is a form of gender discrimination. There are two theories under which an employee may recover for sexual harassment. The first, “quid pro quo” harassment, occurs when any employee conditions any job benefit, or threatens any job detriment, in exchange for sexual favors. The second type of sexual harassment is called "hostile work environment" (or abusive work environment) and is established when the workplace is permeated with discriminatory intimidation, ridicule and insult that is sufficiently severe or pervasive to alter the conditions of employment.
Whether conduct rises to the level of "harassment" is a fact intensive inquiry and we urge you to consult with a lawyer to assess your particular situation and understand your rights.
